EU to upgrade toy safety directive again

On July 18, 2016, the EU notified the WTO of the revision of Annex C in Annex 2 of the Toy Safety Directive (2009/48/EC), reducing the migration of BPA in toys from 0.1mg/L to 0.04mg/L. The deadline for feedback is 60 days after notification, the proposed EU approval date is around the fourth quarter of 2016, and the proposed effective date is around the second quarter of 2018.


Bisphenol A (also known as BPA) is industrially used in the production of polycarbonate (also known as PC plastic), epoxy resin, and polyphenylene ether resin. Its products are widely used in food contact products such as plastic drinking cups, plastic feeding bottles, and coating of food and beverage cans. Recent studies have shown that bisphenol A can lead to endocrine disorders, threatening the health of fetuses and children. The European Union believes that bisphenol A can induce precocious puberty, and has banned the production and import of milk bottles containing bisphenol A since March 2, 2011. The European Commission's Toy Safety Expert Group is also highly concerned about the impact of bisphenol A in toys on children's safety. Based on the scientific evidence on the safety of bisphenol A, the expert group is responsible for recommending to the European Commission to amend the Toy Safety Directive (2009/48/EC) Appendix 2 The limit value for the migration of bisphenol A in the content of Annex C. On June 24, 2014, the European Union issued Directive 2014/81/EU, adding bisphenol A limit requirements to Annex C in Annex 2 of the Toy Safety Directive (2009/48/EC), for children under 36 months of age. Strict restrictions are imposed on BPA in toys or other toys that can be placed in the mouth. On July 18 this year, the EU notified the WTO of the revision of the Toy Safety Directive (2009/48/EC), reducing the migration of bisphenol A in toys from 0.1mg/L to 0.04mg/L. The European Commission stated that it will continue to adjust the limit requirements of BPA in the Toy Safety Directive as new scientific evidence information for BPA becomes available. It can be seen that the EU's control of bisphenol A in children's toys will become more and more strict.


At present, plastics containing bisphenol A are widely used in the production of food contact products. PC plastic bottles (and children's PC plastic bottles) can be seen everywhere in the domestic market. Under the current situation that plastics containing bisphenol A are still widely used, related Enterprises must attach great importance to the further upgrade of the BPA limit requirements in the EU Toy Safety Directive.


The inspection and quarantine department once again reminds toy manufacturers: improve the response mechanism for technical trade measures, timely track relevant information on the WTO/TBT-SPS website and the official journal of the European Union (offical journal of the european union), and keep abreast of the implementation progress of EU directives. Check the raw materials, strengthen the inspection of raw materials and finished products, and make sure to meet the requirements of the new EU directives. Improve product design and processes to avoid the use of high-risk raw materials. Strengthen the quality control of the supply chain and select suppliers with perfect management and reliable quality.
